Submissions sought on methyl bromide reassessment

The reassessment of fumigant methyl bromide is now open for public submissions.

Methyl bromide is an ozone-depleting gas used to kill a wide range of pests, primarily in the quarantine and pre-shipment treatment of timber, logs and other produce for export and import.

This stage of the reassessment process follows more than a year’s work by ERMA New Zealand staff, researching and evaluating information from New Zealand and overseas on the use of methyl bromide. The reassessment application now open for submissions sets out the results of this review and includes the preliminary recommendation that methyl bromide be re-approved in the medium term for quarantine and pre-shipment purposes only, with tighter controls on its use.

A final decision on the future use of methyl bromide in New Zealand will be made by a committee of the Environmental Risk Management Authority in mid-late 2010 once the reassessment application, public submissions and any other information relevant to the reassessment has been considered.

Five-year phase out of insecticide AZM

The insecticide azinphos methyl is to be phased out over five years.

AZM is a broad-spectrum organo-phosphate used in New Zealand to control insects on crops including potatoes, summerfruit and strawberries. Its use has been withdrawn in the European Union and there are moves to phase it out in Canada and the United States. A reassessment is also under way in Australia.

This month, the Environmental Risk Management Authority revoked three approvals to import, manufacture or use AZM formulations not currently in use New Zealand. The one formulation in use in New Zealand was approved for use on potatoes, summerfruit and strawberries until December 2014, subject to additional controls.

The five-year phase-out recognises the need for alternatives to be developed to meet the needs of growers and is based, in part, on submissions providing information on the length of time needed to develop and trial potential alternative products.

Classification framework to be reviewed

ERMA New Zealand, in conjunction with the Ministry for the Environment, is calling for public submissions on proposals to amend the hazardous substances classification framework.

Two sets of regulations provide the hazard thresholds and classifications that determine whether a substance is hazardous under the HSNO Act. The classifications assigned to a substance determine the way it is managed and the conditions placed on its use.

These regulations were originally developed from draft proposals for the United Nations Globally Harmonised System of Classification and Labelling of Chemicals (GHS). The GHS has since been finalised and there are now several areas of difference between the GHS and HSNO regulations.

The discussion document now open for submissions identifies these differences and also compares how the GHS is adopted in New Zealand and proposed for adoption overseas, particularly in the European Union and Australia.

Submitters have until 19 February, 2010, to make submissions. ERMA New Zealand will then advise the Minister for the Environment on the proposals, submissions made and international developments.

If the Government decides to adopt the proposals, the goal is to have the revised regulations in place by the end of 2010.
